OVERVIEW

This website, draw-my-pets.com (the "Site"), is operated by Market Lab ("we", "us", "our"). Browsing or buying on the Site, together the "Service", implies your unreserved acceptance of these Terms of Sale, as well as the other policies available through hypertext links (privacy policy, refund policy and so on).

New features or tools added to the store are also subject to these Terms of Sale. We may update them at any time; the version online at the time of the order prevails.

ARTICLE 1 – CONDITIONS OF USE

  1. You must be of legal age in your country of residence, or have your legal guardian's authorisation.
  2. Any unlawful use (counterfeiting, distribution of malicious code and so on) is prohibited.
  3. Breaching these Terms of Sale results in the immediate suspension or deletion of your access to the Service.

ARTICLE 2 – ONLINE STORE

We reserve the right to:

  • refuse the Service to anyone, at any time;
  • limit the quantities sold or cancel an order (in particular where resale is suspected).

You undertake to provide accurate and up-to-date billing information.

ARTICLE 3 – PRODUCTS AND PERSONALISATION

  • Some items are personalised (pet name, pet artwork). Under article L221-28 of the French Consumer Code, these products are excluded from the right of withdrawal, except in the event of a defect.
  • Product photos are indicative; minor variations in shade or framing may occur.
  • Prices are shown in euros including tax and may be changed without notice.

ARTICLE 4 – ORDER AND PAYMENT

  • The order is deemed concluded upon receipt of the confirmation e-mail.
  • Payment is made through our secure provider (credit card, PayPal, Apple Pay and so on). Card details are never stored by Market Lab.

ARTICLE 5 – DELIVERY

  • The times shown on the Site are indicative. Orders are produced within 5 to 7 working days (personalised products), then delivered within 3 to 5 working days, giving an indicative total of 8 to 12 working days. A tracking e-mail is sent to you as soon as the order ships. These times may vary during busy periods.
  • Risk passes to you when the parcel is handed over to the carrier.

ARTICLE 7 – STATUTORY GUARANTEES

You benefit from the statutory guarantee of conformity (articles L217-3 et seq. of the French Consumer Code), which entitles you to have non-conforming goods repaired or replaced free of charge within 2 years of delivery, as well as from the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code).

ARTICLE 8 – LIABILITY

The Site is provided "as is". Market Lab cannot be held liable for indirect damage, loss of data or service interruption caused by external factors (network failure, force majeure and so on).

ARTICLE 9 – INTELLECTUAL PROPERTY

All content (text, images, logos, algorithms) is protected. No ownership right is transferred to the user.

ARTICLE 10 – PERSONAL DATA AND COOKIES

The processing of your data is governed by the Privacy policy. The Site uses technical, analytics and marketing cookies (with consent).

ARTICLE 11 – CHANGES TO THESE TERMS

We may revise these Terms of Sale at any time; the update date appears at the top of the document. Your continued use of the Site constitutes acceptance of the new terms.

ARTICLE 12 – GOVERNING LAW AND DISPUTES

These Terms of Sale are governed by French law. In the event of a dispute, an amicable solution will be sought first; failing that, the competent courts will be those of the registered office of Market Lab.
